Required referrals to other agencies

Referrals to complaint handling bodies

The Ageing and Disability Commissioner Act 2019 requires the Ageing and Disability Commission to refer certain matters to other agencies. Where we identify that information in a report could be the subject of a complaint to the following agencies, we are required to refer the information to them:

  • NDIS Quality and Safeguards Commission – for example issues relating to the conduct of an NDIS worker
  • Aged Care Quality and Safety Commission – for example issues relating to the conduct of an aged care worker
  • Health Care Complaints Commission – for example issues relating to the conduct of a health care provider

Before making the referral, we will liaise with the reporter, wherever possible, to seek consent for their details to be provided to the other agency. Where the reporter does not provide consent, we will still refer the issues to the other agency, but exclude any identifying information relating to the reporter.

Referrals to NSW Police

The Ageing and Disability Commission is also required to report certain matters to NSW Police. Where we identify that information in a report may provide evidence of a criminal offence, we are required to refer that information to NSW Police.
